Can the penalty for late Corporate Tax registration be waived?
Yes. The FTA will waive the AED 10,000 late registration penalty (and refund it if already paid) if you file your first Corporate Tax return within 7 months of the end of your first tax period, instead of the usual 9 months.

The detail
The AED 10,000 penalty for failing to register for Corporate Tax within the deadline set by the FTA can be waived under an FTA initiative, provided the Taxable Person files its Tax Return (or, for exempt persons, its annual declaration) within seven months of the end of its first Tax Period or Financial Year, instead of the standard nine months. This applies even if the penalty has already been paid, in which case it is refunded to the person's EmaraTax account, and it only applies to the first Tax Period.1
What the law says
- Failure to submit a Corporate Tax registration application within the FTA's specified timeframe attracts a fixed penalty of AED 10,000 under Cabinet Decision No. 75 of 2023.2
- The FTA's waiver initiative (guidance, not legislation) allows this penalty to be waived, and refunded if already paid, where the Taxable Person submits its Tax Return within seven months of the end of its first Tax Period rather than the standard nine months.1 Based on FTA guidance
What it depends on
- The waiver applies only to the first Tax Period, whether past or future.1 Based on FTA guidance
- Persons who paid the penalty but later became exempt from Corporate Tax after FTA approval can still benefit if they submit their annual declaration within seven months of the end of their first Financial Year.1 Based on FTA guidance
- The initiative does not change the normal nine-month deadline for filing and paying tax generally; it only shortens the window for eligibility for this specific waiver.1 Based on FTA guidance
Check before you rely on it
- Confirm your Tax Return for the first Tax Period was (or will be) filed within seven months of its end, not nine.
- Check whether the late registration penalty has already been paid, so you know whether to expect a refund or a waiver.
