The detail

Under Article 31 of the GCC Common VAT Agreement, all food items are subject to the standard VAT rate. Member States may zero-rate specific food items, but only those included in a unified list approved by the GCC Financial and Economic Cooperation Committee; outside that list, food is taxed at 5%.1

What the law says

  • Article 31 of the GCC Common VAT Agreement provides that all food items are subject to the standard VAT rate.1
  • Member States may apply a zero rate only to food items listed on a unified list approved by the Financial and Economic Cooperation Committee.1

What it depends on

  • The item must appear on the approved unified list to qualify for zero-rating; otherwise the standard 5% rate applies.1
  • Even food supplied within an otherwise zero-rated context, such as a school canteen, is standard-rated according to FTA guidance.2 Based on FTA guidance

Check before you rely on it

  • Check whether the specific food item is on the approved zero-rated foodstuffs list before assuming a lower rate applies.
