The detail
Serviced apartments (or hotel apartments) are expressly excluded from the definition of a 'residential building' under Article 37(2)(c) of the Executive Regulations, so the exemption for residential leases under Article 43 does not apply. As a result, the supply of a serviced apartment, whether by sale or lease, is a standard-rated supply subject to 5% VAT if made by a Taxable Person.123
What the law says
- A residential building exempt supply under Article 43 applies only where the leased property meets the definition of 'residential building' in Article 37.12
- Article 37(2) excludes hotel apartments, serviced apartments and similar establishments from the residential building definition.24
- FTA guidance confirms that leasing or selling a building as a serviced/hotel apartment is subject to 5% VAT where the supplier is a Taxable Person.3 Based on FTA guidance
What it depends on
- The exclusion applies specifically where additional services (beyond mere accommodation) are provided alongside the apartment, distinguishing it from ordinary residential accommodation.4 Based on FTA guidance
- The 5% VAT applies only if the person making the supply is a Taxable Person; if not registered, no VAT is charged.3 Based on FTA guidance
Check before you rely on it
- Check whether the apartment lease includes additional hotel-type services (housekeeping, reception, etc.) beyond basic accommodation.
- Confirm the landlord/operator is VAT-registered.

This means that the VAT incurred on costs relating to the first supply of the building should be recoverable in full. The ‘first supply’ includes a supply of the building by either sale or lease, but it must be made within 3 years of the buildings’ completion date. This treatment shall apply regardless of who the building is supplied to (e.g. a registered customer, a nonregistered customer, a related party etc.) provided that it is supplied within the relevant timeframe. The completion date of a building is normally the date the building is certified as being complete by an appropriately qualified party. However, if the building is occupied before this date, the date on which the building is occupied shall be taken to be the date of completion. 3 Article 37(1), VAT Executive Regulations.
